第 1 条 服务说明（Service Description）
1.1 本公司通过网站 orasage.com 及关联移动应用（下称本平台）提供基于人工智能的东方玄学分析报告，包括但不限于八字命理分析、紫微斗数分析、双人合盘分析等（下称本服务）。
1.1 This Company provides AI-driven Eastern metaphysics analysis reports through the website orasage.com and associated mobile applications (the “Service”), including but not limited to Bazi analysis, Zi Wei Dou Shu analysis, and compatibility reports.
1.2 本服务由人工智能算法自动生成，不涉及任何人类大师或专家的参与。
1.2 The Service is generated entirely by artificial intelligence algorithms. No human master or expert is involved in the generation process.
1.3 本服务仅供娱乐和自我参考之用，不构成任何形式的专业建议。
1.3 The Service is for entertainment and self-reflection purposes only and does not constitute any form of professional advice.
第 2 条 用户资格（User Eligibility）
2.1 使用本服务的用户须年满 18 周岁（或所在司法管辖区的法定成年年龄，以较高者为准）。
2.1 Users must be 18 years of age or older (or the age of majority in the user’s jurisdiction, whichever is higher) to use the Service.
2.2 用户须提供真实、准确、完整的注册信息，包括但不限于出生日期、出生时间和出生地点（用于真太阳时校准）。
2.2 Users must provide true, accurate, and complete registration information, including but not limited to birth date, birth time, and birth location.
2.3 用户须对使用本服务所产生的所有活动承担全部责任。2.3 Users are solely responsible for all activities that occur under their account.
2.4 本公司保留拒绝服务、关闭账户的权利，无需说明理由。
2.4 The Company reserves the right to refuse service and terminate accounts without prior notice.
第 3 条 付费与退款政策（Payment & Refund Policy）
3.1 本服务采用免费报告加收费报告的分层模式。免费报告无需付款；收费报告及深度报告需在生成前付款。
3.1 The Service operates on a freemium model. Free reports require no payment. Paid reports require payment before generation.
3.2 所有价格均标示于本平台，本公司保留随时调整价格的权利，价格调整不影响已付款订单。
3.2 All prices are displayed on the Platform. The Company reserves the right to adjust prices at any time; price changes do not affect already-purchased orders.
3.3 退款条件（满足任一即可申请退款）：(a) 付款后报告未能成功生成；(b) 报告内容明显错误或空白；(c) 用户在付款后 7 日内申请退款，且未下载或查看报告内容.
3.3 Refund eligibility (any of the following): (a) The report fails to generate after payment; (b) The report content is manifestly erroneous or blank; (c) User requests a refund within 7 days of payment AND has not downloaded or viewed the report.
3.4 退款不包括：(a) 用户已下载或查看的报告；(b) 因用户提供错误信息（如错误出生时间）导致的报告不准确；(c) 超过 7 日退款期限的申请。
3.4 Refunds are NOT available for: (a) Reports already downloaded or viewed by the user; (b) Inaccuracy caused by user-provided incorrect information; (c) Refund requests beyond the 7-day window.
3.5 退款将在审核通过后 5-10 个工作日内退回原付款账户。
3.5 Approved refunds will be processed within 5-10 business days to the original payment method.

4.1 本服务由人工智能生成，本公司不保证其准确性、完整性、及时性或适用性。
4.1 The Service is generated by artificial intelligence. The Company makes no warranties of accuracy, completeness, timeliness, or fitness for any particular purpose.
4.2 本服务不构成金融、投资、法律、医疗或任何形式的专业建议。用户在任何重大决定（包括但不限于财务、法律、医疗决定）前，应咨询合格的专业人士。
4.2 The Service does NOT constitute financial, investment, legal, medical, or any other form of professional advice. Users should consult qualified professionals before making any major decisions (including but not limited to financial, legal, or medical decisions).4.3 本公司不对用户基于本服务内容做出的任何决定或行动承担任何责任或法律责任。
4.3 The Company shall not be liable for any decisions or actions taken by users based on the Service content.
4.4 本服务不承诺、不保证任何具体结果（包括但不限于改运、化解厄运等）。任何此类表述均属用户个人理解，与本公司无关。
4.4 The Service does not promise or guarantee any specific outcomes. Any such interpretation is solely the users personal understanding and is not attributable to the Company.
4.5 本服务明确披露：所有内容均为 AI 自动生成，基于传统八字、紫微斗数方法论，不代表任何事实陈述。
4.5 The Service explicitly discloses that all content is AI-generated based on traditional Bazi and Zi Wei Dou Shu methodology and does not represent any statement of fact.
第 5 条 知识产权（Intellectual Property）
5.1 本平台的所有内容（包括但不限于文字、图像、报告模板、算法、源代码）均为 Orasage Limited 或其许可方的知识产权，受香港及国际知识产权法保护。
5.1 All content on the Platform is the intellectual property of Orasage Limited or its licensors, protected by Hong Kong and international intellectual property laws.
5.2 用户仅获得本服务内容的使用权（仅供个人参考），不得复制、分发、转让、出售、修改或用于任何商业用途。
5.2 Users are granted a limited license to use the Service content for personal reference only. Users may not copy, distribute, transfer, sell, modify, or use the content for any commercial purpose.
5.3 用户提供的个人数据（出生日期、地点等）在用于生成报告后，本公司不会将其用于其他目的，除非获得用户明确同意。
5.3 Personal data provided by users will not be used for purposes other than generating reports, unless with explicit user consent.
第 6 条 责任限制（Limitation of Liability）
6.1 在任何情况下，本公司均不对任何间接的、附带的、特殊的或后果性的损害承担责任，包括但不限于利润损失、数据丢失、业务中断等。
6.1 In no event shall the Company be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, loss of data, or business interruption.
6.2 本公司对使用本服务所承担的总责任，不超过用户就相关服务实际支付的金额。
6.2 The Companys total liability for any claim arising out of the Service shall not exceed the amount actually paid by the user for the relevant service.
6.3 某些司法管辖区不允许限制默示保证或排除、限制间接损害，因此上述限制可能不适用于您。
6.3 Some jurisdictions do not allow the exclusion or limitation of implied warranties or consequential damages, so the above limitations may not apply to you.
第 7 条 管辖法律与争议解决（Governing Law & Dispute Resolution）
7.1 本服务条款受香港特别行政区法律管辖并据其解释，不适用冲突法原则。
7.1 These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict of law principles.
7.2 因本服务条款引起的或与之相关的任何争议、纠纷或索赔，应首先通过友好协商解决。
7.2 Any dispute, controversy, or claim arising out of or relating to these Terms shall first be attempted to be resolved through friendly negotiation.
7.3 如协商不成，任何一方均可将争议提交香港国际仲裁中心（HKIAC）按照其届时有效的仲裁规则进行仲裁。
7.3 If negotiation fails, either party may submit the dispute to the Hong Kong International Arbitration Centre (HKIAC) for arbitration in accordance with its Arbitration Rules in effect at the time.
7.4 仲裁地点为香港。仲裁裁决是终局的，对双方均有约束力。
7.4 The place of arbitration shall be Hong Kong. The arbitral award is final and binding on both parties.
7.5 本条款中的任何内容均不限制用户向香港消费者委员会或类似机构投诉的权利。
7.5 Nothing in this clause limits the users right to file a complaint with the Hong Kong Consumer Council or similar authority.
第二部分：隐私政策（Privacy Policy）
生效日期：2026 年 5 月 14 日Orasage Limited（下称本公司或我们）高度重视您的隐私。本隐私政策说明我们如何收集、使用、存储和分享您的个人数据，并确保符合《欧盟一般数据保护条例》（GDPR）、《加州消费者隐私法案》（CCPA）及其他适用隐私法律。
1. 我们收集的数据（Data We Collect）
【个人身份数据】 姓名（可选）、电子邮件地址、IP 地址、设备信息 —— 用途：注册账户、发送报告、客户支持
【命理计算数据】 出生日期、出生时间、出生地点（经纬度） —— 用途：生成八字、紫微斗数报告
【支付数据】 付款金额、货币、支付时间（注：信用卡号由支付商保存，我们看不到） —— 用途：处理付款、开具收据
【使用行为数据】 访问页面、点击行为、报告查看时长、设备类型 —— 用途：改进服务、个性化推荐
【Cookie 数据】 会话 Cookie、偏好 Cookie、分析 Cookie —— 用途：维持登录状态、分析流量
2. 数据使用方式（How We Use Your Data）
2.1. 生成并发送您的命理分析报告（核心服务）
2.2 处理付款并发送收据（通过 Airwallex、Stripe 等支付商）
2.3. 提供客户支持（回复您的咨询）
2.4. 改进服务（分析使用行为，优化报告质量）
2.5. 发送服务通知（如系统维护、条款更新）—— 非营销用途
2.6. 防止欺诈和安全事件（监控异常访问行为）
3. 数据共享（Data Sharing）
我们不会出售您的个人数据。仅在以下情况下共享数据：
• 支付商（Airwallex / Stripe）：付款时需要，仅共享必要的最低数据（金额、货币、订单号）
• AI 服务供应商（OpenAI / Anthropic）：生成报告时需要，仅共享命理计算所需的最低数据（出生时间、地点）
• 云服务商（AWS）：数据存储，数据加密存储于 AWS 海外区
• 法律要求：应香港或其他司法管辖区合法要求时，我们会共享数据与第三方共享数据时，我们会签署数据处理协议（DPA），要求第三方提供充分的数据保护。
4.您的数据主体权利（Your Data Subject Rights）
访问权（Right of Access）： 您有权查看我们持有的您的个人数据 GDPR Art. 15 / CCPA
• 更正权（Right to Rectification）： 您有权要求更正不准确的个人数据 GDPR Art. 16
• 删除权（Right to Erasure）： 您有权要求删除您的个人数据（被遗忘权） GDPR Art. 17 / CCPA
• 数据可携带权（Data Portability）： 您有权以结构化、常用、机器可读的格式导出数据 GDPR Art. 20
• 反对权（Right to Object）： 您有权反对我们处理您的个人数据 GDPR Art. 21
• 拒绝出售（Opt-Out of Sale）： 加州居民有权要求我们不出售个人数据 CCPA

5. Cookie 政策（Cookie Policy）
• 必要 Cookie（Strictly Necessary）： 维持登录状态、购物车功能（始终启用，无法关闭）
• 分析 Cookie（Analytics）： Google Analytics，分析网站流量（可在 Cookie 提示中选择拒绝）
• 偏好 Cookie（Preference）： 记住语言偏好、主题设置（可在 Cookie 提示中选择拒绝）
• 营销 Cookie（Marketing）： 目前未使用，未来如启用会另行通知（——）
6. 数据存储与安全（Data Storage & Security）
6.1 存储地点：您的数据存储于 AWS 海外区（美国西部、欧洲法兰克福），不在大陆境内。
6.2 存储期限：您的个人账户数据在账户注销后 30 天内删除；命理报告数据在账户注销后 90 天内匿名化。
6.3 安全措施：
• 传输加密：TLS 1.3
• 存储加密：AES-256
• 访问控制：仅授权技术人员可访问
• 定期安全审计：每年一次第三方安全审计
7. 国际数据传输（International Data Transfers）
由于我们的服务器位于美国及欧洲，您的数据可能会被传输到香港以外的地区。我们确保此类传输符合 GDPR 第 46 条的要求，包括：
• 与 AWS 签署标准合同条款（SCC）
• 与 AI 服务供应商签署数据处理协议（DPA）
• 确保接收方提供充分的数据保护水平
8. 儿童隐私（Children’s Privacy）
本服务不面向 18 岁以下用户。如果我们发现意外收集了儿童的个人数据，将立即删除。父母或监护人有权要求删除儿童的个人数据。
9. 本隐私政策的更新（Updates to This Policy）
我们可能不时更新本隐私政策。重大变更时，我们会在网站上发布通知，并通过电子邮件通知注册用户。建议用户定期查看本政策。
